3. Website Terms Are Separate From Child Care Agreements
These Terms govern use of the website only.
They do not replace, modify, supersede, or serve as:
- An Enrollment Agreement.
- A child care services contract.

- A medical authorization.
- An emergency authorization.
- A transportation authorization.
- A medication authorization.

- Discusses availability with Harmony House Child Care.
Enrollment becomes effective only after Harmony House Child Care accepts the child in writing, all required documents are completed, required payments are made, and any other enrollment conditions are satisfied.

4. Adult Use and Parental Responsibility
The website and its contact forms are intended for adults who are at least 18 years old.
Children under 13 may not independently:
- Submit a contact form.
- Provide personal information.
- Send photographs, videos, or recordings.
- Create or send messages.

- You are at least 18 years old.

- You are the child’s parent, legal guardian, or otherwise authorized to provide the information.
- Providing the information does not violate a custody order, court order, confidentiality obligation, or another person’s rights.
Harmony House Child Care may request proof of identity, guardianship, custody, or authorization.
5. License Information
Harmony House Child Care intends to display its current Florida child care license or registration number as required by applicable law.
The number appearing on the website must be compared periodically with the current license or registration issued by the appropriate licensing authority.
Nothing on the website should be interpreted as representing that:
- A license has no conditions or limitations.
- A license will remain unchanged indefinitely.
- The licensing authority endorses the website.
- The licensing authority guarantees any specific service or outcome.
Official licensing status should be confirmed through the appropriate Florida or local child care licensing authority.
6. Inquiries, Tours, and Availability
Submitting a website inquiry does not:
- Reserve a child care space.
- Create a waiting-list position.
- Guarantee a response within a specific period.
- Confirm a tour.
- Lock in tuition or fees.
- Guarantee acceptance.
- Establish a contractual relationship.
A tour or appointment is confirmed only when Harmony House Child Care provides direct confirmation.
Availability can change without notice. Harmony House Child Care may consider age, authorized capacity, staffing, scheduling, licensing restrictions, program fit, health and safety considerations, completed documentation, and other lawful factors when evaluating enrollment.
Harmony House Child Care reserves the right to decline or discontinue an inquiry when permitted by law.
7. No Emergency Use
The website, general contact form, email address, and social-media accounts are not emergency communication systems and are not continuously monitored.
Do not use them to report:

- A missing child.
- Suspected abuse or neglect.
- An immediate threat.
- A dangerous condition requiring immediate assistance.

For an immediate emergency, contact 911 or the appropriate emergency or government authority.

- Unauthorized information about another person.
- Altered medical, custody, identification, or licensing documents.
- Information intended to mislead Harmony House Child Care or another person.
Harmony House Child Care may rely on information provided by a parent or guardian unless it has reason to believe the information is inaccurate.
You are responsible for informing Harmony House Child Care when important information changes, including contact details, emergency contacts, custody restrictions, authorized pickup persons, allergies, medical needs, or other safety-related information.
9. Communications
When you provide a telephone number or email address and request contact, you authorize Harmony House Child Care to respond regarding:
- Your inquiry.
- Tour scheduling.
- Availability.
- Enrollment.
- Documents.
- Child care operations.

- An enrolled child’s attendance, care, health, or safety.
Consent to receive inquiry-related or operational communications is not consent to receive unrelated marketing communications.
If Harmony House Child Care later uses automated promotional text messages, prerecorded calls, or marketing campaigns, separate consent may be required.
You may request that nonessential promotional communications stop. Operational, safety, enrollment, payment, or legally required communications may still be sent when appropriate.
10. Sensitive Child and Family Information
Do not submit Social Security numbers, banking information, payment-card information, complete medical records, custody orders, passwords, or other highly sensitive information through the general contact form.
Harmony House Child Care may direct parents to provide sensitive records through another method.
You are responsible for reviewing the Privacy Policy before submitting information. The Privacy Policy is incorporated into these Terms by reference.
11. Photographs, Videos, Testimonials, and Media
Acceptance of these Terms does not by itself authorize Harmony House Child Care to publish an identifiable child’s photograph, video, voice, name, testimonial, or likeness.
Identifiable child media should be governed by a separate written authorization signed by a parent or legal guardian.
Visitors may not photograph, record, livestream, or publish images, audio, video, names, schedules, or personal information concerning children, families, employees, or the child care location without authorization.
Nothing in these Terms restricts lawful communications with government agencies, law enforcement, legal counsel, or another person where such restriction would be unlawful.
12. Tuition, Fees, and Online Payments
Unless the website expressly states otherwise, the website does not itself process tuition or enrollment payments.
Tuition, deposits, reservation fees, late fees, refunds, attendance charges, vacation policies, closure policies, and termination obligations are governed by the applicable Enrollment Agreement, payment policy, and Parent Handbook.
General pricing information displayed on the website:
- May change.
- May not include all charges.
- Is not guaranteed until confirmed in an applicable written agreement.
- Does not override a signed contract.
If online payment functionality is added, additional payment terms and updated privacy disclosures may apply.

The website and its content are provided on an “as available” basis for general informational purposes.
To the fullest extent permitted by law, Harmony House Child Care disclaims warranties concerning the website itself, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
This disclaimer concerns the website and digital content. It does not:
- Waive child care licensing duties.
- Waive legally required health or safety obligations.
- Excuse gross negligence, intentional misconduct, abuse, or unlawful conduct.
- Eliminate any right that cannot legally be waived.
- Replace the obligations contained in an applicable child care agreement.
- Limit government enforcement or licensing authority.
Parents and guardians remain responsible for reviewing the Enrollment Agreement, Parent Handbook, licensing information, policies, and other documents before enrolling a child.
19. Limitation of Liability for Website Use
To the fullest extent permitted by law, Harmony House Child Care will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from:
- Inability to access the website.
- Reliance on outdated or incomplete general website information.
- A third-party link or service.
- Loss of an unconfirmed inquiry or message.
- Unauthorized interference with the website outside our reasonable control.
This limitation applies only to claims arising from use of the website.
It does not apply to:
- The actual provision of child care services.
- Personal injury or property damage occurring during child care.

To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable expenses resulting from your:
- Unlawful use of the website.
- Unauthorized submission of another person’s information.
- Misrepresentation of identity, custody, guardianship, or authorization.
- Violation of intellectual-property rights.
- Attempt to damage or compromise the website.
- Material violation of these Terms.
This provision does not require a parent or guardian to indemnify Harmony House Child Care for Harmony House Child Care’s own negligence, misconduct, violation of law, or breach of a child care obligation.
21. Governing Law and Venue
These Terms and claims arising specifically from website use are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, legal proceedings concerning these Website Terms shall be brought in a court with proper jurisdiction in Pasco County, Florida.
Nothing in this section prevents a person from filing a complaint with an authorized government, licensing, consumer-protection, or law-enforcement agency.
22. Changes to These Terms
Harmony House Child Care may update these Terms when website functionality, operations, service providers, or legal requirements change.
Updated Terms will be posted with a revised “Last Updated” date.
Changes apply prospectively from the date they are posted. Changes to the Website Terms do not automatically amend an existing signed Enrollment Agreement unless the enrollment documents separately permit such an amendment and applicable law allows it.

- Violates these Terms.
- Creates a security risk.
- Engages in unlawful conduct.
- Harasses or threatens another person.

24. Severability and No Waiver
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Failure to enforce a provision on one occasion does not waive the right to enforce it later.
25. Entire Agreement Concerning the Website
These Terms and the Privacy Policy constitute the agreement concerning use of the website.
They do not constitute the entire agreement concerning enrollment or child care services. Those services are governed by separately executed documents.
